Users have at their disposal in this section all the information concerning the legal terms and conditions that bind them to the web.

ANAA is responsible for the web and commits itself to process the users information with full guarantees, as well as to fulfil the national requisites, as well as those of the European Union, for compiling and handling users personal information.

 

General conditions of use

The present general conditions regulate the use (including mere access) of the pages which make up the web. Therefore, the user accepts to submit himself to the general conditions which are in force at all times.

A cookie is a file which is downloaded in your computer when you access certain websites.  Cookies allow a website, among other things, to store and recuperate information on the navigation habits of a user or of his equipment and, depending on the information they contain and the way he uses his equipment, they can be used to recognize the user.

In compliance with Art. 22.2 of Act 34/2002 of July 11th on Information Society Services and Electronic Commerce, we inform you that this website does not use its own cookies. Nevertheless, functions provided by third parties are included, so that you can share the contents in social networks such as Facebook and Twitter.

Commitments and Responsibilities

The user is informed and accepts that access to the web does not entail any kind of relation with ANAA whatsoever. Thus, users undertake to use the information and contents of the web in accordance with the applicable law and without contravening good faith or public order.

The use of the web with illegal or harmful ends which can cause any kind or harm or impede its normal functioning is forbidden. As for its contents, it is expressly forbidden:

  • To reproduce, distribute or use it for commercial or advertising aims.
  • To modify it totally or partially, unless expressly authorized by its legitimate owners.

The web user undertakes not to carry out any kind of behavior which could harm the image, the interests and the rights of ANAA’s or third parties’ web, or which could damage, render unusable or overload the web, or which could prevent or hinder its normal use.

On the other side, the user must be aware that internet’s computer systems are not absolutely safe and therefore, ANAA’s web cannot guarantee at all times lack of viruses or other elements which might alter the user’s computer systems.

 

Safety measures

Personal information communicated by the user to ANAA can be stocked, or not, in automated databases whose ownership is exclusively ANAA’s, who will carry out the appropriate technical, organization and safety steps to guarantee its information confidentiality, integrity and quality in accordance with the data protection regulations in force.

 

Claims

The user can claim via email to  protecciondatos@anaaweb.org  stating his name and surnames and specifying the reasons of his claim.

 

Intellectual property

All intellectual property rights on the web (such as texts, pictures, logos, signs, sounds, animation videos, source code, design, navigation structure, database, etc…), belong to ANAA, who holds the right to exploit them as it deems appropriate, especially the reproduction, distribution, public communication and transformation rights. The fact that ANAA grants access to its web, or allow its use, does not mean that it grants any kind of right or license on said rights, contents or information.

Reproduction, distribution, public communication and transformation of any kind, of any of ANAA’S contents subject to intellectual property rights is forbidden, except if the source (ANAA), is mentioned and it is not being used for commercial purposes.

ANAA reserves it right to sue the user for the illegal use of the material and contents of the webpage and for infringing intellectual property rights.

Pursuant to the Intellectual Property Act, it is expressly forbidden to reproduce, distribute or communicate publicly, including the fact of making available all or part of its contents with commercial aims, in any kind of format or by any technical means, without ANAA’s prior authorization.

Should a user or a third party deem that there has been an infringement of his legitimate intellectual property rights by introducing a specific contents in the web, he shall report said matter to ANAA indicating:

  • Personal information of the owner of the rights allegedly infringed, or indicate on behalf of whom he is acting if the claim is presented by of a third party who is not the owner;
  • Point out the contents protected by the intellectual property rights and its location in the web, the certification of said intellectual property rights and make a statement in which the interested party takes responsibility for the veracity of the information stated in the notification.

ANAA, through its web, provides links to other sites and contents which belong to third parties (other animal protection organizations or associations, collaborators’ web pages, etc.). The sole purpose of these links is to provide the user with information to free access and use. It does not presuppose that there is a connection between ANAA and the owners of these webs, nor does ANAA take responsibility for the results which might arise from the access to said link.

Exclusion of guarantees and responsibilities

ANAA does not take responsibility for any damages which might derive from:

  • Lack of availability, maintenance or working order of the web, its services and contents.;
  • Existence of viruses, malware or harmful contents;
  • Illicit, careless, fraudulent use, or use which contravenes this Legal Notice;
  • Lack of lawfulness, quality, reliability, usefulness and availability of the services rendered by third parties and which are at users disposal through said web;
  • Misuse or illegal use of the web.

 

Applicable law and jurisdiction

In a general way, relations between ANAA and users of its webpage are ruled by Spanish Laws and jurisdiction, as well as by Madrid’s courts.
